Privacy Statement

In this Privacy Statement (“Statement”), we, Via Licensing Alliance LLC and our affiliates and subsidiaries (collectively, “Via LA,” “we” or “us”), provide information about how we collect, use and transfer personal information from you as a visitor to www.via-la.com and other websites that we operate and that link to this Statement (collectively the “Site”), or as otherwise set out below.

Scope

This Statement covers data we collect through the Site and/or in connection with our business activities, including in connection with registration for our Via Summits and other events and, where applicable, travel and accommodation arrangements made in connection with such events. This Statement does not cover the data collection or processing practices of third-party websites to which we link. Occasionally, we may refer to this Statement in notices and consent requests related to surveys and special-purpose web pages; under such circumstances, this Statement applies as modified in the particular notice or consent request (e.g., with respect to types of data collected or purposes of collection).

Types of Data and Collection Methods

Through the Site, we receive data that you provide as well as data that we track:

Data You Provide: When you sign up to receive certain types of information, such as patent call announcements, responses to patent license requests, other license-related documents, use the Site to make inquiries or submissions regarding our Licensing Programs, or otherwise send us data, you are providing, and we collect, data such as your name, email address(es), mailing address(es), telephone number(s), and in certain instances, business details. In each such instance, you will know what data we collect through the Site, because you provide it. We also collect your password when you register for any password-protected areas of the Site (e.g., ViaSecure, Web LA).  We also collect personal information when you register for our Via Summits or related events (such as your name, company, position, email address and other contact information), which we may also use for sales and licensing discussions, and, where we assist with travel or accommodation arrangements in connection with such events, we also collect additional information that may be required by hotels, airlines or applicable governmental authorities (for example, passport information that has been required in certain jurisdictions for guest registration).

Passively Tracked Data: When you visit the Site, we may also passively track information on your computer and Internet connection, which may include the IP address of your computer and/or Internet service provider or country of origin, the date and time you access our websites, the Internet address of websites from which you link to our Site, the computer technology you are using and your movements and preferences on our Site. We use technology that many other websites employ, including, without limitation, “cookies” or small data files stored on your computer’s hard drive, to collect information such as the aforementioned. In some instances, we also may use cookies to collect information in connection with future visits from that Site, to recognize you as a previous visitor and to track your activity on the Site. You do not need to have cookies turned on to visit our Site. You can refuse cookies by turning them off on your browser.

In addition, we use third-party visitor identification and analytics tools on the Site, including ZoomInfo’s WebSights and related services, which use cookies and similar technologies to automatically collect data such as your email address, device and browsing information, the organization you may be associated with and the pages you visited on our Site, and to share such data with our vendor for purposes of website functionality, analytics and our sales and marketing activities. Where required by applicable law, including for visitors in California and in the EU/UK, we will obtain your consent before deploying these tools.

To the extent permitted by applicable law, we reserve the right to combine passively tracked data with personal information that you provide.

Collection Purposes, Use of Data

We collect passively tracked data primarily for purposes of administering, protecting and improving our Site and our systems, to better understand the preferences of our Site visitors, to identify server problems, to compile aggregated statistics about Site usage, and to help personalize your experience of our Site.

We collect provided data primarily for the purpose for which you originally provided us the data (e.g., to send information to you or to register you for, and administer your participation in, Via Summits and related events), and we may also use this personal information to: create and manage your account or registration and your communications preferences; communicate with you about, and enable you to participate in, our surveys, events, programs and promotions; offer and provide our products and services to you and respond to your communications, inquiries and requests; manage, operate and improve our business, products and services, including by performing data analyses (such as market and consumer research, trend analysis, and the anonymization of personal information); detect, protect against and prevent fraud, security incidents and other criminal activity, claims and other liabilities, and prosecute those responsible for such activity; comply with and enforce applicable legal requirements, relevant industry standards and our contractual rights and policies; and inform you about our products and services (you can opt out of receiving marketing emails as explained below). In addition, we may use the information we collect about you in other ways for which we provide specific notice at the time of collection.

Where We Store and Process Data

We store data in California and also have servers, contractors and employees around the world.  See here for our locations.

Online Tracking

The Site is not designed to respond to “do not track” signals received from browsers.

Opt-Out 

In connection with promotions or other projects, we may ask you specifically whether you have objections against a certain kind of data use or sharing. If you opt-out under such circumstances, we will respect your decision. To opt-out of receiving further commercial emails or to unsubscribe from services, please contact us at unsubscribe@via-la.com or reply to the individual sender of the email you received with “unsubscribe” in the header or body of the email. Please note that other data recipients have their own data privacy policies, which may differ from ours and you would have to contact them separately with respect to opt-out requests.

Personal Information Sharing

We do not sell, rent or otherwise disclose your personal information to any third parties except as described in this Statement.

We may share your personal information in the following circumstances:

  • with agents, vendors and other service providers who perform services on our behalf (including hosting, data analytics, customer service, marketing and payment processing) – such third parties are subject to confidentiality obligations and may only use personal information shared with them for the purposes of performing necessary services on our behalf;
  • when you authorize or instruct us to do so;
  • where such sharing is required or permitted by law or in the interest of protecting or exercising our or others’ legal rights, including in response to a valid court order, subpoena, government request or law enforcement investigation, and to detect, prevent or otherwise address fraud, security or technical issues; and
  • in connection with a prospective or actual sale, merger, transfer, reorganization, divestiture, dissolution or liquidation of all or part of our business or assets to the acquiror or successor of such business or assets.

We may also aggregate or anonymize personal information in accordance with applicable law and disclose such aggregated or anonymized information to third parties.

Opt-Out

Privacy Rights and Choices

Subject to applicable law, you may have the right to:

  • Request access to your personal information;
  • Correct or amend your personal information;
  • Request the deletion of your personal information;
  • Request restrictions on the use of your personal information, or object to or request that we refrain from processing your personal information;
  • Request that we transfer your personal information to a third party you select;
  • Request that we disclose to you the categories of personal information we have collected about you, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting or selling the personal information, the categories of third parties with whom we have shared the personal information, and the specific pieces of personal information we have collected about you; and
  • Not receive discriminatory treatment from us for the exercise of any of the foregoing rights.

In order to protect your privacy and security, we must verify your identity prior to completing any request that you may submit with respect to your personal information. We will verify your identity by asking you to provide certain information that we have already collected from you to confirm that it matches our records.

While we will make reasonable efforts to accommodate your request, we also reserve the right to impose certain restrictions and requirements on such requests, if allowed or required by applicable law. We are permitted to charge you a reasonable fee to comply with your request.

You may designate an authorized agent to make a request on your behalf pursuant to this Statement or applicable law. Prior to completing a request made by such an authorized agent, we require that you provide your authorized agent with written permission to submit such a request and that you or your authorized agent provide us with a copy of such written permission. Additionally, we require that you verify your identity pursuant to the procedure described above.

California Privacy

We have collected the following categories of personal information as defined in the California Consumer Privacy Act of 2018, Cal. Civ. Code § 1798.100 et seq. and its implementing regulations (the “CCPA”), as modified by the California Privacy Rights Act: identifiers; personal information listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as passport number; commercial information; Internet or other similar network activity; and professional or employment-related information.

We use your personal information for a number of “business purposes” as defined in the CCPA. These business purposes include, without limitation: performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, or providing similar services; auditing related to a current interaction with the consumer; detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; debugging to identify and repair errors that impair existing intended functionality; short-term, transient use; undertaking internal research for technological development and demonstration; and undertaking activities to verify or maintain the quality or safety of a service and to improve, upgrade, or enhance the service.

We do not sell personal information in exchange for monetary compensation or other valuable consideration and have not sold any personal information in the past twelve (12) months. We do not share personal information for cross-contextual behavioral advertising purposes.

You may exercise your rights under the CCPA with respect to your personal information as set forth in the “Privacy Rights and Choices” section of this Statement. We will not discriminate against or retaliate against you if you choose to exercise any of your rights under the CCPA.

Retention of Personal Information

To the extent permitted by applicable law, we retain personal information we obtain about you for as long as you have an account or ongoing relationship with us or the information is needed for the purposes for which we obtained it, in accordance with the provisions of this Statement, unless a longer retention period is required or permitted by law or is necessary to comply with our contractual obligations, resolve disputes or enforce our agreements.

The Site may contain links to other external, third-party websites and apps for your convenience, such as apps, tools, widgets and plug-ins. We are not responsible for the data collection, privacy or other practices of any third parties or the content of other websites and apps to which we link, and this Statement does not cover those practices. We recommend that you review the privacy and other practices of these third parties, websites and apps.

Security

We take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Children’s Privacy

The Site is intended for a general audience and is not directed to children. We do not intentionally or knowingly collect personal information from children under the age of 13 and we request that individuals under the age of 13 not submit any personal information on the Site. If we become aware that we have collected personal information from a child under the age of 13, we will promptly delete the information from our records. If you believe that a child under the age of 13 may have provided us with personal information, please contact us as specified in the Contact Us section of this Statement.

Updates

We reserve the right to change this Statement from time to time and in our sole discretion. We reserve the right to change, modify, add or remove portions of this Statement at any time, but will alert you that changes have been made by indicating on the Statement the date it was last updated. When you visit the Site, you are accepting the current version of this Statement as posted on the Site at that time. We recommend that users revisit this Statement on occasion to learn of any changes.
